1. Who we are and what these Terms cover
These Terms of Service (the “Terms”) govern your access to and use of www.cresmd.co and any subdomain, together with all courses, digital downloads, memberships, communities, coaching and booked sessions, tools, and anything else we make available (together, the “Services”). CresMD is an independent Canadian medical education practice based in Alberta (“CresMD”, “we”, “us”). Our Refund & Cancellation Policy and Privacy Policy form part of these Terms.
2. Acceptance
By creating an account, buying a product, or otherwise using the Services, you confirm that you accept these Terms and agree to be bound by them. If you do not agree, please do not use the Services. If you are using them on behalf of an organisation, you confirm that you have authority to commit that organisation.
3. Eligibility and accounts
You must be at least 18 years old, or the age of majority where you live, to buy from us or hold an account. Please give accurate registration details and keep them current. You are responsible for keeping your login confidential and for everything that happens under your account. Accounts are personal to you and may not be shared, transferred, sold, or used by more than one person. We may suspend or close any account we reasonably believe is being shared or used in breach of these Terms.
4. Educational purpose only: no professional advice
What we provide is educational and examination-preparation material for medical graduates. It is not medical advice, clinical guidance, legal advice, immigration advice, or a career guarantee, and it must never be relied on to diagnose or treat a patient or to make a clinical decision. Nothing in the Services creates a physician-patient relationship, a supervisory teacher-student relationship, or a professional advisory relationship. You remain fully responsible for your own practice, your professional obligations, and your regulatory compliance.
5. No guarantee of results
CresMD is independent. We are not affiliated with, endorsed by, or connected to the Medical Council of Canada, the College of Family Physicians of Canada, the Royal College, CaRMS, any provincial medical regulator, or any examination body. Where we name an examination, it is only to describe what our material prepares you for. We work hard on quality, but we cannot guarantee any examination result, score, pass, licence, residency match, interview, or job. Testimonials on our site describe individual experiences; they are not typical results and they are not promises.
6. Prices, payment, and taxes
Prices are shown at checkout and can change at any time before you buy. You agree to pay the price in effect when you place your order, plus any applicable taxes. You must use valid payment details that you are entitled to use. Payments are handled by third-party processors, and we do not store your full card details. Where a product is sold on a subscription or instalment basis, you authorise the recurring charges until you cancel in line with our Refund & Cancellation Policy.
7. Your access and licence
Once you have paid, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the material you bought for your own individual study, for the access period stated at purchase or, where none is stated, for as long as we continue to offer that product. This is a licence to use, not a sale, and it gives you no ownership of the material.
8. Our work, and what you may not do with it
Everything in the Services, including videos, text, images, question banks, mock examinations, answer keys, templates, trackers, cheat sheets, branding, and the way our courses are structured, belongs to CresMD or to those who license it to us, and it is protected by copyright and other laws. A great deal of time and expertise goes into it, so please respect it. You must not, and must not let anyone else: copy, reproduce, download (except where we deliberately enable a download), record, screenshot, screen-capture, scrape, or mirror the content; share your login or give access to another person; resell, sublicense, rent, distribute, publish, or post the content anywhere, including on social media, messaging groups, file-sharing sites, or competing platforms; use the content to build, train, or fine-tune any artificial intelligence or machine-learning model, or to create derivative or competing material; remove or alter any watermark, copyright notice, or attribution; or try to get around any access control, digital rights management, or usage limit. Breaking this section is a serious breach of these Terms, and we may suspend or end your access immediately without a refund and pursue every remedy open to us, including an injunction and damages.
9. Community, discussions, and what you post
Where the Services let you post, please do not post anything unlawful, defamatory, harassing, discriminatory, misleading, confidential, or infringing, and never post identifiable patient information or real examination material copied from any examination body. You keep ownership of what you post, but you give us a worldwide, royalty-free licence to host, display, and moderate it so that we can run the Services. We may remove content and pause participation at our discretion. Behaviour that is abusive or threatening towards us, towards anyone who works with us, or towards other learners may end your access immediately and without a refund.
10. Acceptable use of the platform
Please do not interfere with or disrupt the Services, try to reach any system or account you are not entitled to, introduce malicious code, use automated tools to access or extract content, misuse coupon codes or promotions, create multiple accounts to get free or discounted access, or use the Services for anything unlawful.
11. Third-party services and links
The Services run on and connect to third-party platforms, and we sometimes link to other sites. We are not responsible for their content, availability, or practices, and your use of them is governed by their own terms.
12. Availability and changes
We aim to keep everything running smoothly but cannot guarantee uninterrupted or error-free access. We may update, improve, restructure, or retire content, features, or whole products at any time. If we retire something you have bought before you have had a fair chance to use it, we will offer you a comparable replacement, an extension, or a pro-rated credit or refund at our discretion.
13. Refunds
Refunds and cancellations are governed entirely by our Refund & Cancellation Policy, which forms part of these Terms.
14. Suspension and ending access
We may suspend or end your account or access, with or without notice, if you breach these Terms, if a payment fails or is reversed, if we reasonably suspect fraud or misuse of our material, or if the law requires it. You may stop using the Services whenever you wish. Ending your access does not entitle you to a refund except as set out in our Refund & Cancellation Policy, and Sections 8, 15, 16, 17, and 19 continue to apply afterwards.
15. Disclaimers
To the fullest extent the law allows, the Services and all content are provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, currency, or non-infringement. We do not warrant that the content is complete, perfectly aligned with any current examination blueprint, or suited to your particular circumstances.
16. Limitation of liability
To the fullest extent the law allows, CresMD and anyone working with us will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profit, opportunity, examination fees, income, data, or goodwill, arising out of or in connection with the Services, however caused. Our total liability arising out of or relating to the Services or these Terms will not exceed the total amount you actually paid us in the twelve (12) months immediately before the event that gave rise to the claim. Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or anything else that cannot lawfully be limited.
17. Indemnity
You agree to indemnify and hold harmless CresMD and anyone working with us against any claim, loss, liability, or reasonable cost (including legal fees) arising from your breach of these Terms, your misuse of the Services, your infringement of anyone else’s rights, or anything you post.
18. Changes to these Terms
We may amend these Terms from time to time. The amended version takes effect once it is posted on this page, and the version in force when you buy governs that purchase. Where a change is significant, we will take reasonable steps to let you know. Continuing to use the Services after a change takes effect means you accept it.
19. Governing law and disputes
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there, and you and CresMD submit to the exclusive jurisdiction of the courts of Alberta, without affecting any mandatory consumer protection rights you have where you live. Before starting any formal proceeding, please email us at [email protected] and allow us thirty (30) days to try to put things right.
20. General
If any part of these Terms turns out to be unenforceable, the rest still applies. If we do not enforce something straight away, we have not given up the right to enforce it later. You may not transfer your rights under these Terms; we may transfer ours if CresMD is ever transferred or sold. These Terms, together with the Refund & Cancellation Policy and the Privacy Policy, make up the whole agreement between you and CresMD about the Services.
